Happy birthday to the most charming sister on the planet. Right from when you were a little kid and till today, you have given us reason to be proud. We are so lucky to have you in our lives. Time flies so fast, But I can still remember those times when I carried you in my arms while dancing the Britney Spear's music just for you to sleep; those times you were waiting for me back home to arrive from school just have your spaghetti as promised; and those times when I brought you to school and you don't wan't me to leave the room. For many years we've shared our lives. One roof we once lived under. Sometimes we laughed, sometimes we cried through hard and happy times. The younger years have faded so fast but our bond, love and friendship last.

You are starting a new chapter of your life. Always remember, you are God's masterpiece. You are loved, there's no one in this world like you. Don't let other people define you, just be yourself. Be who God creates you to be, not who someone else tells you to be.

Be strong and courageous, don't be afraid to choose the right thing even if your friends are choosing the wrong one. Nobody is perfect. When you stumble, pick yourself up and get back in the game. Learn from your mistakes and move forward. You can't turn back time and age but you can surely turn back life's new page. You can't undo what happened in the past but there's still a lot you can do to have a blast.

We know that you are now mature enough to take responsibilities. But we are always here to support you along the way. Remember, no matter what life may bring, never lose faith in God. No matter how bad the day, how mean other people are to you or how hard the choice you have to make, we are always behind you because you are our special gift. We always think the best for you.

Right from when you were a little kid and till today, you have given us reason to hold out heads up in pride. We are so lucky to have you in our lives.

Time flies so fast, we can still remember the first day of your school. On that day, you don't want us to leave you in the classroom. Slowly you learned to be on your feet and socialized with your classmates.

Your precious childhood memories are always stored in our hearts – the little things you have said and done, the sound of your laughter and the sight of your tears. Those moments were so precious, how quickly they passed. You are no longer a baby boy. As we look at you, we want you to know that we are filled with pride of what you have become. Even though all of this has happened too fast, we are grateful beyond words for the happiness you have brought to us. We love you and thank you for bringing joy and laughter in our lives.

While looking at you walking on stage to receive your diploma, tears started to manifest how happy and proud we are of you. You made us more proud when you received your academic medals and ribbons. As what we have told you, educational success is not about the medals and ribbons received but how you apply what you have learned in school towards success and in your daily lives. Be that as it may, you have worked so hard for this, your serious effort have paid off and you have achieved a great success, it's time to celebrate your graduation.

You have hurdled another level of your education and is now ready to face another chapter. We know that you are now mature enough to take responsibilities. We are always here to support you along the way. Remember, no matter where you go or how successful you become, never lose faith in God. Always be humble. We, your parents, always think the best for you. We may not carry you now in our arms but we will always carry you in our hearts. You have given us so many reason to be proud of the man you have become.

The Graduates And Their Dreams

Take time to read my simple speech given during a graduation ceremony five years ago.

To our beloved school principal, hardworking teachers, supportive parents, our dear graduates, and to all who attend this memorable graduation ceremony, good morning.

Before I proceed, I would like to thank the school administration, headed by our principal, for choosing me as your keynote speaker.

How are you dear graduates? I know how happy you are right now. I was once in your position. I know how excited you are to receive the fruit of you labor. Perhaps you are also excited to go home because there is a celebration waiting for you. But before anything else, did anyone of you approach his/her parents or teachers and say “thank you” to them? It's not yet too late, after this you approach and thank them for all those years of molding, patience, understanding, and efforts they have done to you. I know your parents and teachers cannot also explain how happy they are right now watching you sitting there and receiving your diplomas. At this moment, may I ask you dear graduates to please stand and give a round of applause to your teachers and most specially to your ever supportive parents.

Dear graduates, I want you to do something for me. Please take a look of your fellow graduates. Look at you classmate on your left and on your right. Now consider this, 10 years or more from now, odds are your fellow graduates might become a doctor, lawyer, engineer, teacher, nurse, priest, businessman, a good father or mother, mayor and perhaps president of this country. And you, in the middle? What can you expect?

You are the person endowed with potential, capability, skill, talent and intelligence that can build a strong and wealthy nation. All you have to do is to believe in yourself and put it in action.

I will ask you a question. Who among you here have dreams in life? Please raise your hand. I challenge you graduates, how can you achieve your dreams or goal in life if you can't even manage to raise your hand? Now, for the last time, who among you here have dreams in life? Why I ask you that question? Because the poorest person in this world is not the person who don't have money but the person who don't have dreams in life.

According to a survey conducted by Harvard University, out of 100% who have dreams in life, only 3% put their dreams in writing and plan to accomplish them. These 3% were the people who achieved their goals and dreams in life. How about you? Did you put your dreams in writing? If you put it in writing, you will become more focused and determined to achieve it.

What you want to become after graduating? What course you want to take up in college? What you want to do after college? What you want to accomplish? You must have a dream or goal in life. As the bible says in the book of proverbs, “A person who does not have a goal in life is like a ship without a rudder.” If you don't know where you are going, every road will get you nowhere. People don't plan to fail, they fail to plan.

Dream big dreams – it's free. Allow yourself to dream and fantasize about the kind of life you would like to live. Project yourself 10 to 15 years forward. Whatever it is, take the first step today. Because if you can dream it, you can do it. As the MILO slogan goes, “Great things starts from small beginnings.”

Believe that you have the power to transform your thought into physical reality, you can dream and make your dreams come true. Cherish them as they are the children of your soul and the blueprint of your ultimate achievements. Napoleon Hill says “Whatsoever the mind of man can conceive and believe, it can achieve.

Dear graduates, a while ago I have asked you to give a round of applause to your parents. Why? Because it's your parents who gave you the opportunity to receive good education in order to achieve your dreams in life. Your parents did this to you because it is the only treasure and legacy they can give. An opportunity which is a product of their hardwork because they know that they will not always be around, even your teachers. This opportunity will come only once, so don't dare to waste it. Cherish this opportunity and nurture it. This is your ticket to success.

What we are celebrating right now is just the start of your battle in pursuit to receive good education and to achieve your goals. Always remember, that merely going to school or involvement is not enough. You must commit and sacrifice yourself to attain your worthy goals because I believe that the purpose of education is action, to bring out the talent and intelligence we are born with.

I can still remember how my parents work hard so that I will be able to achieve what I am right now. In the process I also help my parents. In the young age, I experienced and learned how to plant, harvest and sell tobacco, sell bananas in the neighborhood, cook food, feed animals, tend our small store, etc. We studied hard and we were only allowed to watch tv once a week during Fridays or Saturdays. Now, I also urge you dear graduates to also help your parents. They are not superheroes who can give you everything you want. They are not banks who can give you money anytime you want. They are just humans. Always listen to them because they are good source of wisdom even though some of them haven't attained what you have accomplished at this time. My father once told me, “Do your best in your studies and in your life and don't go back to what you have experienced before. Nobody would give you even a single peso.”

Most of us are easily discouraged or frustrated if someone tells us that we are not good enough. We easily give up our dreams to dream stealers. Dear graduates, don't allow anybody to steal your dreams. It is yours to fulfill. No one should stop you from achieving it. You must have strong attitude – become deaf in all discouragements, failures and obstacles that you may encounter along the way. Remember, the greatest reward in life is doing things that other people say you cannot.

You can be wrong and fail, and still succeed. You don't have to be super talented and very smart to succeed. You should be persistent. Have courage, don't quit. You only have to have one good success. When you succeed everyone forgets your mistakes. Why? Because mistakes wont matter as long as you continue to reach for your success in life.

If you never do anything, you wont make a mistake. Get started making some mistakes so success will come your way. Just remember, if you want to accelerate the rate of your success, you mu st double the rate of your failure. Success is on the far side of failure... dare to fail. As the famous words of Winston Churchill goes “Never, never, never, never give up.” You must have the G.U.T.S. (Genuine Urge To Succeed).

Let me give you an example. I have in my hand a P1,000 bill. Who want a P1,000 bill? Now, what if I crumple, drop or throw this bill? Will you still beg for it? Dear graduates, you have all learned a very valuable lesson. No matter what I did to the money you still want to have it because it did not decrease in value – it still worth P1,000.

Just like us, many times in our lives, we were dropped, crumpled and ground into dirt by the decisions we made and the circumstances that come our way. We feel as though we are worthless, but no matter what has happened or what will happen to us – We will never lose our true value. We are born with power to surmount all the odds that are stacked against us; to be able to bounce back after each fall; to be able to break free from any limitations; to claim rightful place on this planet; to be the master of our circumstances; and to be the creator of our destiny.

Your courage to persist in the face of adversity and disappointments is one quality that will guarantee you to achieve your goals in life. Your willingness to persevere longer than anyone else is your greatest personal asset. It is your ability to focus your desire and to desire your focus.

Dear graduates, if you cannot finish college don't be frown because it's not yet the end of your quest to become successful citizen in this country. In fact, many successful people have left school without receiving a college degree. Like Henry Ford, founder of Ford Motors Company; Thomas Edison, founder of General Electric; Ted Turner, founder of CNN; Ralph Lauren, founder of Polo Ralph Lauren Corporation; Bill Gates, founder of Microsoft Inc.; Steve Jobs, co-founder of Apple Inc.; Joseph Estrada, former president of the Philippines; and your favorite people's champ, Manny Pacquiao. Life experience is their wise and great teacher. Like these personalities, you must commit yourself to lifelong learning. Continuously sharpen your saw. If you stop learning that is the beginning of your downfall because you stop growing. We are what we repeatedly do, excellence then is not an act but a habit.

Don't you know that God has plan for us? It is well stated in the bible in Jeremiah 29:11-12. It says “I have plans for you, declares the lord, plans to prosper you and not to harm you, plans to give you hope and a future.”

I hope someday, one of you will come to me and say “Neil, here I am, a successful lawyer, doctor, teacher, father, etc.” When that time comes, your teacher, parents, me and this country will be proud of you.

Before I end my speech, let me leave this wonderful poem to you.

Happy Birthday My Dear Brother

I can't believe that it was 27 years ago today when I met you for the first time. Since that day you have grown up to the smartest and most amazing person.

On your birthday my dear brother, I look back and see the time we spent together, the joy we shared – including those times we teased your teeth, the knees we scrapped as we climbed the tree of life, and the laugh we had living the life we live. The reasons that made them special, memorable and unforgettable.

The once annoying teasing habits we had during our childhood years became unforgettable memories. No matter what our differences are, there's nothing that can come close to the unspoken love and support of a brother. Words are not sufficient to describe the bond we shared. A brother who is more than just part of the family.

Even though we don't talk much, even though we don't hangout together, even though we don't spend a lot of time with each other – I know from the bottom of my heart that you are always there. Though we travel our separate roads, no matter what life brings, I will always be proud of you.

Thanks for being a perfect brother to your sisters. You have shown to be protective without being strict, liberal without being careless and watchful without being stiffing.

Also, thank you for being there for our parents. For taking care of them when we are not around. You have shown and we have felt that your love and generosity knows no bounds. Though your love is not romantic yet it is powerful than romance and more supportive than friendship. You have done thoughtful things without any fuss.

I know you are smart and tough that you never whine about your woes and problems. At most you hardly asks for anyone’s help. You just faces and solves them. But just remember, we are always here for you.

Throughout life I have seen you making mistakes, being at your lowest point yet you managed to stand up on your feet heads up. Nothing compares to the joy of having a brother like you.

Walls of marble, pillars of granite or slabs of stone cannot be as strong as you my brother. I am so happy of your chosen career to serve and protect the people. Your safety is always our concern and always in our prayers.

You are a good brother, supportive and selfless and most of all a good son. A good husband who always does his best to provide his family, as all husbands should. Words cannot express how proud we are of you. An absolute blessing to the family, a source of inspiration and joy. I admire you completely.

As I wish you the best birthday ever, it brings a smile on my face to see that we have another eternity to make such fond memories with us and your family. In your next phase in life, I pray that our heavenly father will guide, protect and lead you, and you will fulfill your aspirations. I know what you are capable of doing. 28 years ago on the 7th day of February, a beautiful baby was born to a lovely family. She is considered a blessing to them.

She is tough but with a soft heart specially to her family and friends. They think she is strict but you've got to know her to check yourself that you are wrong. She never delve about her problems, she doesn’t complain about them. She hardly asks for anyone’s help. She confidently faces and solves them. She is at her best in this way. She isn’t lazy. She works hard and wisely.

Her family knows her best than anyone else. But those who knew her, they, well, know who she is, where she’s been, what she’s done in and with her life, what she is capable of doing.

Does she cry? Oh yes, in her sacrifices and in her success. This will definitely a sign of relief to her and will make her strong. But where does she sourced her strength? God, family and friends. She pray hard but does what she prayed instead of waiting for God's blessing. Most of the times she is a blessing to others. She even think of other people than herself. That even her civil status is a sacrifice. I have seen her do this several times. It doesn’t really matter who she helps. No need to be a relative, or a friend. She helps if she can, doing this without expecting anything in return like most people had in mind.

She is a very sweet sister, generous and thoughtful, supportive and selfless. She is not selfish or self-centered about her. A good daughter to her parents. She cares of them and makes sure they are always all right.

Yes she is intelligent. She is a bookworm yet humble. She share what she learned. This is manifest to the people she met and the patients she handles.

I am confident a huge success awaits her. I personally know what she is capable of doing. Many times she stumble and the bumps she has met in her life have made her fall but she always managed to pick herself up and bounce back with confidence. Yes, she is smart.

She is beautiful. Once a beauty queen in her young age, an experienced my daughter emulates. She is our Miss Universe, confidently beautiful with a heart.

More fruitful, longer and happier years for her to continue to touch lives and kiss her dreams. Our love and support will always be there. We love you ate

Plea Bargaining’s Innocence Problem | Thought Paper

A research was conducted which discusses the fact that guilty students/participants are more likely than innocent students/participants to accept plea bargain.

Plea Bargain are ways to ensure a favorable disposition of a case and is also an agreement to allow someone accused of a crime to admit being guilty of a less serious crime in order to be given a less severe punishment.

In the experiments conducted by different researchers, participants who are found guilty are more likely to accept a plea for they knew that the cost of a trial is worth the risk, and the reward from the plea bargain was not large enough to offset it. The Innocent participants on the other hand, who fears conviction , chose the option that offers the most rewards at the least cost which is accepting a plea deal and avoid a potentially lengthy prison term. Participants weighing plea bargains may consider substantive fairness and comparative fairness when deciding whether to accept or reject such plea. In the study conducted, plea bargaining was addressed to the participants without the presence of a defense lawyer and that could have add another dimension in the discussion.

The main purpose of this thought paper is to affirm that Innocent people/participants who accepts plea bargaining are more potentially at risk. Innocent participants refusal to accept plea bargain and to plead guilty made them believed that they could not be wrongfully convicted for committing such crime. Unlike those participants who are guilty indeed, they bargain for much lesser sanctions. In contrast, those innocent participants who don’t want to undergo trial or run the risk of being imprisoned when convicted, choose optimizing a strategy which basically offers the most rewards of less cost which is to accept plea bargains, especially so if the deal contains probation to avoid potentially lengthy imprisonment or prison term.

In the article of Russell D. Covey, entitled “Signaling and Plea Bargaining’s Innocence Problem” " Plea bargaining’s innocence problem is, at bottom, the result of a signaling defect. Innocent defendants lacking verifiable innocence claims are pooled together with guilty defendants who falsely proclaim innocence. As a result, both groups of defendants are treated similarly at trial and in plea bargaining.” It is emphasized in this article that the innocent participants undergo the same process or trial with those who are really guilty of committing an offense. The person might plead innocent but because of the fact that he or she is already charged, there is no option left but to less likely plead guilty in which it is so unfair and degrading on his part. Those who are truly guilty thereof should deserve the punishment for an offense but then again, they still have the privilege for plea bargaining. Accepting a lesser plea helps minimize cost for the innocent participants but then there are factors that must be considered and one of these is the agreement between the prosecution and the defense lawyer. The prosecution protects the public interest and the defense protects the interest of the defendants. Even if the participant is factually innocent of the offense, this information cannot affect the plea prices if it will not be discussed to the prosecution or jury which basically means that they are still convicted for said offense.

In this situation, both innocent and guilty participants are given equal rights to plea bargain, may the punishment be lenient or harsh. The participants knowledge of innocence or guilt affects the bargaining process. Participants who perceives themselves guilty of the offense are more likely to discount their chances of trial or acquittal while those participants who perceives themselves innocent, believes they will be acquitted and that is the reason why most of them wanted to go for trial for it is through the court proceedings, their claim of innocence will be justified.

Indeed, innocent participants who accepts plea bargain as sanction to an offense or crime not committed puts them at risk. Pleading guilty for an offense, for they are left with no choice, despite the fact that their conscience is clear makes it so unfair for the person. While those who are guilty indeed are still given the opportunity to plea bargain for much lesser punishment. Innocent participants take the risk of undergoing the rigors of tedious and lengthy trials which would basically hamper their studies, other personal obligations and responsibilities.
